TERMS OF SERVICE — KATANAFLOW RECORDS

DOMAINS AND STORE IDENTITY (IMPORTANT NOTICE)
Please note the following regarding the identity of our store:
• KATANAFLOW RECORDS is the name of our website (our brand name). It is not a domain — it is the trade name under which the store operates.
• customgiftsong.store is the primary domain of the online store (the main web address).
• account.katanaflowrecords.store is the customer account domain (used for customer login and account management).
All of the above addresses — including katanaflowrecords.store and www versions — refer to one and the same online store operated by the Merchant. Any reference to "the Store" in these Terms applies equally to all of these domains.

1. GENERAL PROVISIONS
These Terms of Service govern the relationship between OPULENCE INTERIORS LTD (Company ID 202994957, VAT No. BG202994957, registered office: 21 Prof. Hristo Danov St., floor 7, apt. 701, Sofia 1700, Republic of Bulgaria), hereinafter referred to as the "Merchant", and any person, visitor or customer of the online store operating under the brand KATANAFLOW RECORDS, with primary domain customgiftsong.store (hereinafter the "Store"). The Store offers personalized musical gifts and digital audio products to customers throughout the European Union, the United Kingdom, the United States, Canada and other countries worldwide.

2. ACCEPTANCE OF TERMS
By using the Store, the user declares that they are at least 18 years of age (or 16 with parental consent in the applicable jurisdiction), have read these Terms and accept them in full.

3. PRODUCTS AND SERVICES
The Merchant offers personalized songs, music videos, binaural audio files and other digital products. Each product is created individually upon the customer's request.

4. PRICES AND PAYMENT
All prices are listed in EUR/USD, including VAT where applicable. Payments are processed via Shopify Payments, Stripe, PayPal and other authorized providers. Prices for customers in the USA are in USD; for the EU, in EUR.

5. DELIVERY
Digital products are delivered electronically to the e-mail address provided by the customer within 1 to 3 business days after payment. The Store operates globally — Europe, North America, Australia and other regions.

Delivery of the Ambient Album: The Ambient Album is a larger production that requires additional work and studio processing. For this reason, the delivery time for the Ambient Album is 4 to 7 days after payment, delivered electronically to the e-mail address provided by the customer.

6. RIGHT OF WITHDRAWAL (EU/UK)
In accordance with Article 16 of Directive 2011/83/EU, the right of withdrawal does NOT apply to personalized products made to the customer's order. The customer expressly agrees to this when placing an order.

7. US CONSUMER RIGHTS
For customers in the United States, all sales of custom-made digital products are final. Refunds are issued only in cases of technical defect or non-delivery, in accordance with applicable state consumer protection laws (including but not limited to California, New York and Texas).

8. INTELLECTUAL PROPERTY
All musical works offered through KATANAFLOW RECORDS are created with the help of AI technologies. KATANAFLOW RECORDS holds the commercial rights to the created content.

a) LICENSE GRANTED
With the purchase, the customer receives a perpetual, non-exclusive license for commercial use, including:

✅ Publishing on social media (YouTube, TikTok, Instagram, Facebook)
✅ Streaming platforms (Spotify, Apple Music, Deezer, etc.)
✅ Podcasts, advertisements and corporate videos
✅ Background music in venues, shops and public spaces
✅ Personal use: listening, gifting, personal collection

b) RESTRICTIONS
❌ Reselling the music as a standalone product
❌ Sublicensing or transferring the rights to third parties
❌ Copyright registration — not guaranteed for AI-generated music

c) DISCLAIMER
⚠️ The music is created with the help of AI technologies. KATANAFLOW RECORDS does not guarantee copyright registration or exclusivity of the works.
⚠️ When publishing on streaming platforms, the customer is obliged to declare the AI origin of the music in accordance with the requirements of the respective platform.
⚠️ KATANAFLOW RECORDS is not liable for violations of platform rules by the customer.

9. DATA PROTECTION
Personal data is processed in accordance with the GDPR (EU 2016/679), the CCPA/CPRA (California) and other applicable laws. See our Privacy Policy.

10. LIABILITY
The Merchant is not liable for indirect damages. The maximum liability is limited to the value of the order paid.

11. GOVERNING LAW AND JURISDICTION
For EU customers: Bulgarian law and EU law apply; the competent court is the court of the consumer's place of residence.
For US customers: governed by the laws of the State of Delaware, USA, with disputes resolved via binding arbitration under AAA rules, except where prohibited by state law.

12. AMENDMENTS
The Merchant reserves the right to amend these Terms at any time. The current version is published on the Store's website (primary domain customgiftsong.store, also accessible via katanaflowrecords.store).
